These terms are the agreement between you and 3044 Pleasant LLC, the company that operates PES Game Platform at pesteck.com.
In short: you need to be 18 or over, you are responsible for your account, we license the games to you rather than sell you ownership of them, and either of us can end the arrangement. The full text is below and it is the version that governs.
The summary is a convenience. The numbered sections below are the operative text, and they are published here in full — this page does not link out to a copy hosted somewhere else.
1. Who you are agreeing with
PES Game Platform ("PES", "the platform", "we", "us") is operated by 3044 Pleasant LLC, a limited liability company. Where these terms refer to an agreement with us, the contracting party is 3044 Pleasant LLC.
You can reach us about anything in this document at [email protected]. We answer legal and account questions at that address; there is no separate channel you have to be routed to.
2. Accepting these terms
You accept these terms when you tick the confirmation box during registration, and again each time you use the platform. If you do not accept them, do not create an account and do not use the service.
We may change these terms. When a change materially affects your rights or obligations we will tell you before it takes effect, by a notice on the platform and, where you have given us a contact detail, a message to it. Continuing to use the platform after a change takes effect means you accept the revised terms. If you do not, you may close your account, and we will not charge you for the notice period.
3. Eligibility
You must be at least 18 years old to hold an account. By registering you confirm that you are.
You must also not be barred from receiving the service under the laws that apply to you, and you must not have had a previous account closed by us for a breach of these terms.
4. Your account
You may register with an email address or a mobile number. Whichever you choose becomes the identifier for your account and the address we use to verify that a request genuinely comes from you.
You are responsible for keeping your password confidential and for activity that takes place under your account. Tell us promptly at the support address if you believe someone else has gained access to it.
- Provide accurate registration details and keep your contact detail current.
- Do not share, sell, rent or transfer your account to anyone else.
- Do not register an account on behalf of another person without their authority.
- One person may hold one account unless we agree otherwise in writing.
5. What we license to you
Games and content on the platform are licensed, not sold. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and play the titles available to your account, for your own non-commercial use.
That licence does not transfer any ownership to you. Intellectual property in the platform and in the titles remains with us or with the studios that made them.
6. Acceptable use
The platform is a shared space and these rules exist so it stays usable. We may act on breaches proportionately, from a warning through to closing an account.
- Do not cheat, exploit defects, or use unauthorised software that gives you an advantage in competitive play.
- Do not harass, threaten, impersonate or abuse other players or our staff.
- Do not attempt to gain unauthorised access to any account, server or network connected to the platform.
- Do not copy, decompile, reverse engineer or redistribute the platform or its titles, except where that right cannot lawfully be restricted.
- Do not use the platform to distribute malware, unlawful material, or unsolicited commercial messages.
- Do not use automated means to scrape, overload or interfere with the service.
7. Competitive play
Tournaments we run are governed by these terms together with the published rules for the specific event. Where the two conflict on a point of competition, the event rules govern that point.
We publish the rules, the format and the prize arrangements before registration opens, and we do not change the competitive balance of a title between the opening of registration and the conclusion of a bracket. Critical stability fixes remain possible and will be announced before they are applied.
8. Purchases and refunds
Where the platform offers paid content, the price and what you receive are shown before you pay. Taxes may be added where the law requires it.
If a paid item does not work as described, tell us at [email protected] within 14 days and we will refund it. This does not affect any statutory refund or cancellation right you have under the law of your own country, which continues to apply regardless of anything in this section.
9. Availability
We aim to keep the platform available but we do not promise uninterrupted service. Maintenance, faults, and dependencies outside our control can all interrupt it.
We may add, change or withdraw titles and features. Where we withdraw a title you have paid for, and you cannot reasonably continue to use it, we will offer a refund for the unused portion.
10. Suspension and closure
You may close your account at any time by writing to us from your registered contact detail.
We may suspend or close an account that breaches these terms, that we reasonably believe is being used unlawfully, or where we are required to do so by law. Except where it would be unlawful or would defeat the purpose of the action, we will tell you why and give you a route to respond.
11. Disclaimers
Except as these terms expressly state, and to the extent the law allows, the platform is provided "as is" and we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
12. Limitation of liability
To the extent the law allows, neither party is liable to the other for indirect or consequential loss, loss of profit, loss of business, or loss of data that was not caused by that party's breach.
To the extent the law allows, our total liability arising out of or in connection with these terms in any twelve-month period is limited to the greater of the amount you paid us in that period and one hundred United States dollars.
13. Indemnity
You agree to indemnify 3044 Pleasant LLC against claims, losses and reasonable costs arising from your breach of these terms or your unlawful use of the platform. We will notify you of any such claim promptly and will not settle it without your consent, which you will not unreasonably withhold.
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, and you may bring proceedings in your local courts.
Before starting formal proceedings, please write to [email protected] setting out the dispute. Most matters are resolved that way, and we commit to responding substantively within 30 days.
15. General
- If any provision of these terms is held unenforceable, the rest continues in force.
- A delay in enforcing a right is not a waiver of it.
- You may not assign your rights under these terms; we may assign ours to a successor of our business, on notice to you.
- These terms, the Privacy Policy and any event rules that apply to you are the entire agreement between us on their subject matter.
